BandFiles helps the people in a band's crowd hand their concert video to that band. Fans upload clips for free; the band previews them for free and pays only to download the ones it wants to keep. These terms cover both sides, plus how we handle your data. By using BandFiles you agree to them.
For fans (uploaders)
What you're doing
You're sending video you filmed at a live show to the band that performed it. You don't need an account. You just verify your phone number so we can keep the service free of spam and abuse.
Your phone number stays private
The band never sees your phone number or any contact info. We use your number only to verify you, prevent abuse, and (if you opt in) send you a single text when the band downloads your video.
The rights you grant
By uploading, you confirm that you personally recorded the video and that you grant the band a license to use it (for example, in their promotion and social posts). You keep ownership of your video. You are only giving the band permission to use it.
What you must not upload
Don't upload anything you didn't film yourself, anything that breaks the law, or anything that is explicit, hateful, harassing, or violent. We can hide or remove any clip and freeze or ban an uploader who breaks these rules.
Free, and short-lived
Uploading is always free. If the band doesn't download a clip within 72 hours, it is permanently deleted. We are a temporary hand-off point. We are not a place to store your videos.
Texts (optional)
The download text is optional and off by default. If you opt in, you get at most one text when the band downloads your footage; reply STOP to opt out at any time. Message and data rates may apply.
For bands (account holders)
Your account
You create an account with an email and password or a Google/ Microsoft sign-in. Keep your login secure; you're responsible for activity on your account.
Preview free, pay per download
You can preview every clip your fans send for free. To download an original, you buy download packs (currently $2 per download, sold in packs of 5, 10, or 25) through our payment processor, Stripe. We don't store your full card details.
Once you download, we let go
When you download a clip, that original is delivered to your device and BandFiles keeps no copy. Clips you don't download are deleted after 72 hours. Download what you want to keep in time.
Use footage responsibly
Only collect footage of your own performances. The video belongs to the fan who filmed it and is licensed to you for your use. Respect that, and respect any venue or third-party rights that may apply.
Reporting and moderation
If a clip shouldn't be there, report it. Reported clips are hidden immediately and reviewed by us. We may suspend accounts or remove content that violates these terms.
No guarantees
We can't promise how many clips you'll receive or their quality. That depends on your crowd. Downloads are digital goods delivered immediately, so purchases are generally non-refundable except where required by law.
Privacy
What we keep, and for how long
For fans: your phone number (to verify you and prevent abuse) and your video. Videos live in secure cloud storage only until you-the- band download them or until the 72-hour window passes, then they are deleted. For bands: your account email, profile, and purchase records.
Previews are watermarked
The copy a band previews is a watermarked version. The pristine original is only delivered after the band pays to download it, and both copies are deleted on the same 72-hour schedule.
The anonymity gap is by design
Fans and bands can never see each other's contact information through BandFiles. We don't sell your data, and we don't share fan phone numbers with bands.
Cookies
We use only the cookies needed to keep you signed in. We don't use them for advertising.
Copyright & DMCA
Reporting copyright infringement
BandFiles responds to valid notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe a clip infringes a copyright you own or control, send a written notice to our designated agent (below) with your signature, the work you say is infringed, enough detail for us to find the clip, your contact information, and a good-faith statement made under penalty of perjury. We remove reported clips promptly. Because clips auto-delete after 72 hours, the material is often already gone.

Counter-notice and repeat infringers
If your clip was removed by mistake, you may send our agent a counter-notice. In appropriate cases we terminate fans or bands who repeatedly infringe. Knowingly filing a false notice or counter-notice can make you liable for damages under 17 U.S.C. § 512(f).
The legal basics
Service "as is"
BandFiles is provided as is, without warranties. To the extent the law allows, we aren't liable for indirect or consequential losses arising from your use of the service.

Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. We would rather fix a problem than fight about it, so please contact us first. Any dispute we cannot resolve that way is handled in Placer County, California.
